Terms of Service

1. Acceptance of Terms

By accessing or using Pocket Kings (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. These terms constitute a legally binding agreement between you and Verbas (“we”, “us”, or “our”), the company operating Pocket Kings at pocketkings.app.

We may update these terms from time to time. Continued use of the Service after changes have been notified constitutes acceptance of the revised terms.

2. The Service

Pocket Kings is a tournament management tool designed for home poker games. It provides blind timers, player tracking, elimination handling, rebuy management, and a TV-friendly display view. The Service is intended for personal, recreational use among friends and family in a private setting.

Pocket Kings is not a gambling platform. It does not facilitate real-money wagering, hold any player funds, or operate as a licensed gambling service. Any money that changes hands during a game you manage with this tool is solely your responsibility and must comply with applicable laws in your jurisdiction.

3. Accounts

To use the Service you must create an account using a valid email address. You agree to:

• Provide accurate and complete information when registering.
• Keep your account credentials secure and not share them with others.
• Notify us immediately at info@verbas.io if you believe your account has been compromised.
• Maintain only one account per person. Duplicate accounts may be removed without notice.

You are responsible for all activity that occurs under your account.

4. Subscriptions and Billing

The Service is available on a free tier and a paid Pro plan. The Pro plan is offered at:

• Pro Monthly: £5.99 per month
• Pro Annual: £50.00 per year

All prices are inclusive of applicable VAT where required. Billing is handled by Stripe. Your subscription renews automatically at the end of each billing period unless you cancel beforehand. By subscribing you authorise us to charge your payment method on a recurring basis.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period; you retain full Pro access until that date.

We reserve the right to change our pricing with reasonable notice. Any price changes will be communicated by email before they take effect.

5. Refunds

We do not offer refunds for partial billing periods. When you cancel, your Pro access continues until the end of the period you have already paid for, after which your account reverts to the free tier. No credit or refund is issued for unused time.

If you believe you have been charged in error, please contact us at info@verbas.io within 14 days of the charge and we will review your case.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation, including laws relating to gambling in your jurisdiction.
• Scrape, crawl, or otherwise extract data from the Service in an automated manner without our written consent.
• Reverse engineer, decompile, or attempt to derive the source code of the Service.
• Introduce malware, viruses, or other harmful code into the Service.
• Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
• Use the Service in a way that could impair, overburden, or damage its infrastructure or interfere with other users' access.
• Operate the Service in connection with any form of commercial gambling or wagering that requires a licence.

We reserve the right to determine, at our sole discretion, what constitutes a violation of this section.

7. User Content

You retain ownership of all game data, player records, and other content you create through the Service (“User Content”). By using the Service you grant us a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display your User Content solely for the purpose of operating and improving the Service for you.

We do not sell your User Content or use it to train machine learning models. You are solely responsible for the accuracy of any data you enter, including player names, buy-in amounts, and prize distributions.

8. Service Availability

We aim to keep the Service available at all times but we make no guarantee of uptime or continuous availability. The Service is provided on a best-effort basis. We may perform scheduled or emergency maintenance, which may result in periods of downtime. We will endeavour to notify users of planned outages where possible.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability to you.

9. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

In no event shall our total liability to you for all claims arising from or relating to the Service exceed the total amount you paid to us in the twelve months preceding the claim. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

10. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these terms, engaged in fraudulent activity, or if required to do so by law. We will make reasonable efforts to notify you before termination except where doing so would compromise security or where prohibited by law.

Upon termination, your right to access the Service ceases immediately. Provisions of these terms that by their nature should survive termination will do so, including sections on liability, governing law, and dispute resolution.

11. Changes to These Terms

We may revise these terms periodically to reflect changes in the Service, applicable law, or our business practices. Where changes are material, we will notify you by email to the address associated with your account at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection law in your country of residence provides otherwise.
